Conditions
The organisation making the request must meet the following conditions:
- It is non-profit.
It is therefore important that the so-called non-restitution clause be included in the Statutes: “If the association is dissolved, its assets shall be transferred to an institution pursuing public interest goals similar to those of the association”. A check will be made that the Statutes are in conformity with the Swiss Civil Code.
- It does not undertake religious or political advocacy.
- It has activities in at least two countries.
- It has regular activities in the Canton of Geneva.
The association must set up its headquarters or representation under Swiss law, and have a street address in the Canton of Geneva. A post office box (alone) is not enough. It must also demonstrate that it has real activities in Geneva.
- It must fall within the framework and conditions in the State Council Decree of 15th of October 2008 setting out the criteria for evaluating requests from NGOs for assistance with installing and maintaining themselves in Geneva. This text sets out the criteria, but cannot be invoked to claim a positive outcome. The State Council decides freely and there is no appeal.
- It exhibits transparency with regard to its sources of finance, in accordance with the Law on Supervision of Administrative and Financial Management, and Evaluation, of Public Policies 19 January 1995 of the Loi sur la surveillance de la gestion administrative et financière et l'évaluation des politiques publiques (LSGAF) of the 19 th of January 1995.
